Amended B-BBEE Act and EE Act in full force – EconoBEE Newsletter – 27 October 2014

EconoBEE - BEE Points = Business The Amended B-BBEE Act and Employment Equity Act are now set to be in full force.

The Department of Trade and Industry (dti) has released the Broad-Based Black Economic Empowerment (B-BBEE) Amendment Act No. 46 of 2013.The act was assented by President Jacob Zuma and published for general information in Government Gazette No. 37271 (Notice No. 55) of 27 January 2014.The amendment act aims to strengthen the implementation of B-BBEE and its reporting across the economy, as well as to put in place mechanisms to deal with non-compliance.

The act has several objectives, including aligning it with other legislation that deals with B-BBEE and the Codes of Good Practice. It also seeks to establish the B-BBEE Commission to create an institutional environment for monitoring and evaluating B-BBEE.

In terms of the Amended Employment Equity Act, all designated companies must perform an analysis of their business, submit an Employment Equity Plan and submit EE reports. The deadline for submitting reports manually was end September 2014, but the department of labour allows on-line reporting until mid-January 2015.

The Employment Equity Act is quite harsh on offenders. If you don’t get your plan and reporting right, the dept of labour can take far-reaching action including large fines. It is not a matter of logging onto a web site and submitting data. The Department of Labour checks your submission and if it does not make sense they can take action.
